Zack 229 ist im Handel erhältlich


Liebe Leserinnen und Leser,
im Editorial der Oktober-Ausgabe 2017 von ZACK hatte ich mich darüber ausgelassen, warum die Serie Marcel Labrume von Attilio Micheluzzi in diesem Magazin nicht fortgesetzt werden kann, und habe mich dabei auf Aussagen unseres Lizenzgebers und Geschäftspartner Michel Jans von den Editions Mosquito bezogen. Am 1. Mai 2018 erreichte mich nun eine Mail von Agnese Micheluzzi, der Tochter von Attilio Micheluzzi und Vertreterin der Micheluzzi-Erben, auf die ich in dem besagten Editorial eingegangen bin. Diese Mail möchte ich der Ordnung halber und auf Wunsch von Frau Micheluzzi hier im Original abdrucken:
Dear Mr. Tempel,
below you will find my version of the reasons for the breakdown of the relationship between the Heirs Micheluzzi and the Editions Mosquito.
Our relationship with Michel Jans began in 1999. The first publication of my father‘s works, Attilio Micheluzzi, dates back to 2003. Seventeen years of relationship based solely on trust. Our family, especially my mother Giovanna, has always considered Michel a friend.
Mosquito was granted with publishing rights upon agreements devoid of the characteristics and elements required by the applicable rules for copyright protection. One single sheet of paper for each work listing title of the work, format, circulation, royalties and advance. Whereas the contracts between Mosquito and other publishers are 5 pages long.
Regarding the assignment of rights of publication abroad, our verbal agreement was that Michel would notify us any received request that would be accepted only with our consent. Plus, he was to provide us with a cd containing the scans of the original drawings. For our archives, since our family is selling the originals. Because of the trust put in Michel, we never checked reports, payments, etc.
In March 2017, by mere chance and with utter astonishment and deep concern we became aware of the fact that Editions Mosquito, through Edmond Lee, agent of the Humanoides Associés (agent that we have never met, nor authorized, nor approved), was about to conclude a contract for the publication of Attilio Micheluzzi‘s integral work with an Italian publisher, presenting itself as the holder of intellectual property rights related to the arts and works of Attilio Micheluzzi. We Heirs Micheluzzi knew nothing about it. By investigating we found out that 3 other Italian publishers had already signed contracts with Editions Mosquito. Through Edmond Lee.
When asked about Mr. Lee and the reason why we had not been informed of his collaboration, Michel replied that he had forgotton to tell us. For 4 years!
The contracts stipulated either by Mr. Lee or by Editions Mosquito itself, read: “Editions Mosquito…. represented by its president, Michel Jans, acting as sole proprietor of the rights…” Such a circumstance definitely constitutes a serious and material breach of copyrights and intellectual property rights since in no event have the Heirs ever granted to Editions Mosquito any copyright and/or other intellectual property rights related to the arts and works of Attilio Micheluzzi, nor it has been ever permitted to present itself as owner and/or co-titular of any such rights.
Neither abroad nor, let alone, in Italy.
We trusted Michel.
One year has gone and we haven’t received from Editions Mosquito any of the requested documents. That’s why we had to turn to a lawyer.
Therefore yes, the relationship with Michel and the “new generation” Micheluzzi has changed. We’ve been forced to reconsider the whole nature and purpose of our relationship with him. Now he can no longer cheat on an old lady with impunity.
What has been written in your editorial, which can be read worldwide, is severely detrimental to my reputation. And I have to thank Michel for this.
